Prosecutors said in a motion that the similarities between the two churches, and that Roof was still armed, "supports the inference that Defendant meant to continue his racially-motivated violence at Branch AME Church that night and, more specifically, that his intended targets were African-American congregants at a church". They argued the evidence was "irrelevant", and Roof had driven past the church.

Roof must still face a death penalty trial in state court, which was postponed during his federal trial and has not been rescheduled. Roof is also seeking a new federal trial, saying prosecutors didn't have jurisdiction to bring their case against him.
