The Supreme Court ruled Monday that North Carolina's Republican-controlled legislature unlawfully relied on race when drawing two of the state's congressional districts. By super-stacking some congressional districts with black voters, the GOP could dilute the Democrats' power in other districts, thus paving the way for a congressional delegation in which 10 Republicans and just three Democrats now represent North Carolina in Congress.

"Although States enjoy leeway to take race-based actions reasonably judged necessary under a proper interpretation of the Voting Rights Act, that latitude can not rescue District 1", Justice Elena Kagan said in her majority opinion, as The Hill reports.

Since Republicans took over many state legislatures in 2010, they have drawn districts with what African American and Democratic critics claim are more blacks than necessary, in order to keep surrounding districts whiter - and more Republican.

While lawmakers said they ignored race in redrawing the state's congressional districts and focused exclusively on party affiliation, the result is the same: divided communities and rigged elections that continue to deny North Carolina voters of their constitutional right to have a voice in choosing their representatives.

Chief Justice John G. Roberts Jr. and Justices Anthony M. Kennedy and Samuel A. Alito Jr. objected. Alabama left open two questions that Cooper and an earlier case from this term, Bethune-Hill v. Virginia State Board of Elections, try to answer: (1) How does a court go about deciding whether a state drew an individual district predominantly on the basis of race such that strict scrutiny applies?

Despite the Supreme Court's decision, the 2011 map has served Republicans well in North Carolina even as it has made its way through state and federal court. "So long as the legislature chose to retain the basic shape of District 12 and to increase the number of Democrats in the district, it was inevitable that the Democrats brought in would be disproportionately black".

If the plaintiffs' alternative plan meets the redistricters' political objectives but provides greater racial balance, then a court knows that race is really at issue.

While the districts have already been redrawn, Amy Auth, a spokeswoman for Senate Leader Phil Berger, said Monday that the uncertainty in the court's decisions on this case have made redistricting hard.

Kagan, along with liberal Justices Ginsberg, Sotomayor and Breyer, plus conservative Justice Clarence Thomas, found race was the factor. It was argued before Justice Neil M. Gorsuch joined the court, and he took no part in the decision.
