Doe, who called herself a singer-songwriter and identified husband John Doe as a guitarist, producer and recording engineer, said the couple performed several songs as an audition, including an original song she wrote about her daughter, which she said Mary asked them to perform. In one moment, she alleges, Tyra Banks "physically manipulated" Mary by shaking her and pulling on her hair.

"Banks, an individual acting as an agent of Defendants, physically manipulated and verbally abused Mary".

Banks is also said to have ridiculed the song by insinuating that Mary was accidentally conceived, all while cameras were focused on the young girl's face.

The woman, identified in the filing as Jane Doe, filed a lawsuit against Banks on Tuesday in L.A. Superior Court accusing the former model of battery and assault, and seeking damages for infliction of emotional distress, reports Variety.

A few weeks after this event, the girl's parents asked that their performance and the reaction of their child not be broadcast on television. However, the suit alleges that Marathon Productions got Mary to sign a contract without her parents' knowledge or consent. She claims that the song is about her close bond with Mary, who was present for the performance on set and "held a certain long-term emotional importance" to the song. While the judges weren't feeling the song, the parents say they did not have a problem with their crticism as much as they did with Banks's interaction with their daughter back stage. The America's Got Talent host, who replaced Nick Cannon after his sudden exodus, is at the center of a new lawsuit filed against the show's producers. The result of this negative experience caused by [the issue] and the abusive treatment of the defendant, Mary left traumatized and deeply depressed. In conversations with the Does, the show's producers apparently agreed to cut out all the footage of Mary, but insisted on still airing the performance itself. "Mary did not stop Banks' conduct because Mary was fearful", the suit reads.

Banks, Marathon, and NBC have yet to comment on the lawsuit.
